On social media, a video of Jaco Swart reportedly assaulting his wife, Nicoleen Swart, has gone viral. He was identified by a former journalist and spokeswoman for AfriForum’s private prosecutions.
Swart has pleaded guilty to causing serious bodily harm with the intent to do so. After the case was dropped from the docket last year, Nicoleen called the lobbying group AfriForum for help.

Swart was caught on CCTV pushing, punching, and striking his wife at their business in 2018, according to Barry Bateman of AfriForum Private Prosecution Unit.
Reportedly, the CCTV footage was not utilized in court, and the state’s attempt to include the evidence was denied until the video’s authenticity could be verified.

AfriForum Private Prosecution Representative Stand for Nicoleen Swart Justice
Since the case was stricken off the list last year, AfriForum’s Private Prosecution Unit became engaged. The lobbying group stands for Nicoleen Swart’s help.
According to Bateman, the judge granted Swart’s request for a lighter sentence after recognizing his contrition.

Nicoleen expressed her dissatisfaction with the court’s punishment but expressed satisfaction with the guilty verdict. She also urged all women to speak out against gender-based violence.
Advocate Gerrie Nel submitted a letter to the Director of Public Prosecutions (DPP) at that time, indicating that private prosecution would be undertaken. The DPP then ordered that the defendants be prosecuted in May 2021.
Following Swart’s sentencing, Advocate Gerrie Nel bemoaned the criminal justice system’s apparent lack of desire to address gender-based violence.
He noted that they are presented with the criminal justice system’s lip service to the battle against gender-based violence, as well as a lack of dedication and expertise to properly care for victims of gender-based violence.
