The criminal defense attorney, Sasha Philips, claimed that although Marc Fogel’s Russian legal representative filed an appeal and will present it to the court soon, they have no grounds to believe that it will reduce his sentence because they consider it politically motivated.

The family said they occasionally correspond via translated, censored letters that frequently lose context.

Marc Fogel’s criminal defense attorney at the Khimkinsy Court of the Moscow Region, Sasha Phillips, gave his word implying that the designation of “wrongfully detained” would commit more US government resources to secure his release and transfer his case to the US government jurisdiction.

Phillips further added in his statement, “Marc fully cooperated with the investigation and prosecution; submitted substantial proof of prior medical treatment, of debilitating health conditions, and of his doctor’s recommendation for medical marijuana.”

“This sentence is grossly disproportionate to sentences imposed by Russian courts in similar cases involving similar amounts of marijuana and even exceeds sentences imposed by Russian courts on major drug traffickers and murderers,” she said.
